This presentation will address the underlying knowledge needed to approach the bargaining table. Topics will include pertinent bargaining statutes, an understanding of union structures, auditing your CBA before approaching the bargaining table, and preparing administration for potential bargaining issues.
We will discuss what bargaining looks like: who the players are, the atmosphere at the bargaining table, communicating proposals, reaching tentative agreements, reaching impasse, etc.
There are terms and provisions that often get included in collective bargaining agreements that come back to bite school districts. And there are terms and provisions that school districts often wish they had included. So, we will discuss language in collective bargaining agreements that should be avoided and language that should be included.

A refresher on how to be as prepared as possible before meeting the union at the bargaining table. Learn how to develop your bargaining priorities and strategy, pick your team, and establish ground rules.
Learn how to properly identify mandatory and permissive subjects of bargaining while at the bargaining table. You will also learn how your bargaining responsibilities with the union differ with each. Spoiler alert: they will differ a lot.
Impasse, Difficult Union Personalities, Expired Contracts, Oh My. These are all things which can and, at some point in your career, will come up. Learn how to plan for the unexpected at the table.
This presentation will start by discussing who your stakeholders actually are. Hint - they include all your employees, board members, parents, and voters. We’ll also share what you can say. Here’s another hint - you can take the high road and still include some barbs. Other topics include how to craft your communications, when to communicate, where you can make statements, and why effective communication outside of bargaining is as important as the bargain itself.
Learn how to spot unfair labor practices while at the bargaining table. This presentation will explore common ULPs committed while bargaining, such as bad faith bargaining, refusing to bargain, regressive bargaining, and circumvention of union representatives. You will learn both how to address these issues when the union commits a ULP and, more importantly, how to avoid ending up on the wrong side of one.
